Please read these Terms of Use carefully and in their entirety before using erhop.org(hereinafter referred to as the “Site”). The Site and its content are owned by Elk River House of Prayer, Inc..
PURPOSE: These Terms of Use are here to clearly explain, outline, and layout the rules, terms, and conditions of using, viewing, and/or browsing the Site and/or purchasing or downloading any services, reports, digital materials, or products offered on or through the Site.

“Site” means erhop.org and any and all of its associated pages, tabs, landing pages, forms, or sub-pages.

Because many of the resources, courses, and digital materials provided through this Site are delivered immediately upon purchase or access, all sales are generally final. Refunds are not provided for digital products, downloadable resources, online courses, or other content that has already been accessed or delivered, except where required by applicable law.
For registrations related to conferences, events, or other ministry activities, any applicable cancellation or refund terms will be communicated at the time of registration and shall govern those purchases.
If Elk River House of Prayer, Inc. provides consulting, speaking, ministry, or other professional services, payment and refund terms will be governed by a separate written agreement where applicable.

18. Arbitration Agreement; Class Action Waiver:
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Agreement to Arbitrate. You and Elk River House of Prayer, Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms of Use, the Privacy Policy, the Site, or your use of any services, events, courses, digital materials, or other resources provided through the Site (collectively, “Disputes”) shall be resolved exclusively through binding arbitration rather than in court, except as expressly provided below. This agreement to arbitrate is intended to be interpreted broadly to the fullest extent permitted by applicable law.
Arbitration Rules and Process. Arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, except as modified by these Terms. The arbitration shall be conducted before a single arbitrator. Unless otherwise agreed by the parties, arbitration shall take place in the State of Minnesota or, where permitted by the AAA Rules, may be conducted by telephone, videoconference, or written submissions. The arbitrator shall apply the substantive laws of the State of Minnesota, without regard to its conflict of laws principles, and may award any remedy available under applicable law, subject to these Terms. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court having jurisdiction.
Fees. Arbitration fees shall be allocated in accordance with the applicable AAA Consumer Arbitration Rules unless otherwise required by law. Each party shall bear its own attorneys’ fees and costs unless the arbitrator awards otherwise under applicable law.

Either party may seek temporary, preliminary, or permanent injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights, confidential information, or other proprietary rights. Either party may also bring an individual claim in a court of competent jurisdiction that has jurisdiction over small claims matters, provided the claim qualifies under applicable law.
Class Action Waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND ELK RIVER HOUSE OF PRAYER, INC. AGREE THAT ANY DISPUTE SHALL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims of multiple parties or preside over any class, collective, or representative proceeding. If this class action waiver is held unenforceable, then this arbitration provision shall be unenforceable only to the extent required by applicable law.
Jury Trial Waiver. BY AGREEING TO THESE TERMS, YOU AND ELK RIVER HOUSE OF PRAYER, INC. UNDERSTAND AND AGREE THAT, EXCEPT AS EXPRESSLY PROVIDED HEREIN, ANY DISPUTE WILL BE RESOLVED THROUGH ARBITRATION RATHER THAN A COURT PROCEEDING, AND EACH PARTY WAIVES THE RIGHT TO A TRIAL BY JURY TO THE FULLEST EXTENT PERMITTED BY LAW.
19. Consent to Governing Law:
These Terms of Use, and any dispute arising out of it, shall be governed by the laws of the State of Minnesota.
20. Consent to Jurisdiction:
You hereby consent to the jurisdiction and venue of the state and federal courts located in the State of Minnesota for any legal action or proceeding arising out of or relating to these Terms of Use, the Privacy Policy, the Disclaimer, or your access to or use of the Site, including any services, events, courses, digital content, products, or other materials provided through the Site, except where these Terms require that a dispute be resolved through binding arbitration.
To the extent Elk River House of Prayer, Inc. is registered or authorized to conduct activities in Kansas as a foreign entity, nothing in these Terms shall be construed to waive, limit, or alter any jurisdiction, venue, service-of-process, or compliance obligations that may apply under Kansas law.
21. Consent to Service:
You agree that service of process in any legal action or proceeding arising out of or relating to these Terms of Use, the Privacy Policy, the Disclaimer, or your use of the Site may be made in any manner permitted by the applicable laws and rules governing such proceeding. You waive any objection to the method of service to the fullest extent permitted by applicable law.
22. Payment & Purchases:
When you purchase or download any services, reports, or digital materials through the Site, you may pay by credit card, debit card, or other payment methods made available at checkout.
By submitting your order, you authorize Elk River House of Prayer, Inc. to charge the payment method you provide for the amount due. You will receive an electronic receipt following your purchase, which you should retain for your records.
If you elect the installment or “pay over time” option at checkout, you authorize Elk River House of Prayer, Inc. to charge your payment method for the amounts and on the dates disclosed at the time of purchase.
Payment processing companies may have different privacy policies and practices than we do. We are not responsible for the policies of the payment processing companies. As with any online purchase, there are circumstances beyond our control which may compromise your credit card or payment method. We are not liable or responsible for any of those circumstances.
You hereby release us from any and all damages related to your payment or use of our payment processing companies in which you incur and further agree not to assert any claims against us or them for any damages which arise from your Purchase or use of our Site and its Content.
23. Limitation of Liability:
Elk River House of Prayer, Inc. is not responsible or liable in any way for any and all damages you receive directly or indirectly from your use, Purchase, or Download from our Site, Services and/or Products. We do not assume liability for damages, injuries, harm, death, misuse of (or failure to properly use) information or documents, due to any act, or failure to act, by you. Notwithstanding anything to the contrary contained herein, your sole and exclusive remedy for negligence, failure to perform, or breach by us shall be a refund of the amount paid for such service or product. IN NO EVENT SHALL WE BE LIABLE TO YOU FOR ANY INDIRECT, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES. You agree to indemnify, defend, and hold harmless Elk River House of Prayer, Inc. and its members, employees, contractors, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
(a) your use of the Site or its Content;
(b) your violation of these Terms of Use, the Privacy Policy, or any applicable law; or
(c) any content, information, or materials you submit, transmit, or provide to us.
This indemnification obligation does not apply to claims arising from our gross negligence or willful misconduct.
